Workplace Exams Rule - June 2, 2018


The new Working Place Examinations rule will go into effect on June 2, 2018. MSHA has stated that they will not issue citations related to the new Workplace Exams Rule until Oct. 1, 2018. This move will give operators time to understand the rule and the agency time to provide additional compliance assistance. However, the agency may issue citations in the case of extremely dangerous hazards.

MSHA published a final rule on Examinations of Working Places in Metal and Nonmetal Mines on April 9, 2018. The rule will still go into effect on June 2 and reflects the somewhat positive changes proposed in September 2017. While KCSA remains concerned about some aspects of the rule, we are pleased MSHA has adjusted the enforcement schedule. 

MSHA has also added more opportunities for stakeholders to learn about the rule. An additional in-person meeting will be held invarious locations around the country, and two additional virtual meetings will be held May 10 and June 6. More information on these meetings is available at the Office of the Federal Register. Unfortunately, those wishing to participate can only do so from an MSHA office capable of receiving the video transmission.
